Release of Liability Statement.

READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS In exchange for participation in the activity of working with Roosevelt Library, 311 Roosevelt Avenue, San Antonio, Texas, 78210, on use of the property, facilities and services of Roosevelt Library, I agree for myself and (if applicable, for the members of my family) to the following:

1. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Roosevelt Library, or the employees, representatives, or agents of Roosevelt Library.

2. I recognize that there are certain inherent risks associated with the above described activity (especially the performance of fitness activities) and I assume full responsibility for personal injury to myself and others, and further release and discharge Roosevelt Library for injury, loss, or damage arising out of my presence at or participation in activities on the premises of Roosevelt Library, whether caused by the fault of myself, my family, Roosevelt Library, or other third parties that may be present.

3. I agree to indemnify and defend Roosevelt Library against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my participation in these activities.

4. I agree to pay for all damages to the facilities and/or property of Roosevelt Library or that of any third parties associated with these activities, caused by my or my family's negligent, reckless, or willful actions.

5. I affirm that I am participating in these activities of my own free will, and shall be responsible for every aspect of my own safety, conduct, and/or statements made in the course of performance of activities governed by this Agreement.

6. In no event shall Roosevelt Library, its officers, directors, managers, members, affiliates, employees, contractors, agents or representatives be liable under any theory of liability, whether in an equitable, legal, or common law action arising hereunder for contract, strict liability, indemnity, tort (including negligence), or otherwise, for damages which, in the aggregate, exceed the amount of the fees paid by you for the services which gave rise to the damages during the month in which such damages occurred, notwithstanding the failure of essential purpose of any remedy.

7. This Agreement shall be governed by the laws of the State of Texas, excluding the conflicts of law provisions of any state or jurisdiction. Roosevelt Library and you each submit to the exclusive jurisdiction of the courts of San Antonio, Texas for the enforcement of this Agreement or any action arising out of or relating to this Agreement.

8. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement prior to execution. A copy of this Agreement shall be made available upon request.

9. This Agreement and each of its terms are the product of an arms' length negotiation between the parties. In the event any ambiguity is found to exist in the interpretation of this Agreement or any of its provisions, the parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a particular party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity.

10. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.

11. This Agreement sets forth the entire understanding of the Parties and supersedes all previous and contemporaneous written or oral negotiations, commitments, understandings and agreements relating to the subject matter contained herein. No changes or modifications to any provisions of this Agreement shall be effective unless evidenced in writing, signed by authorized representatives of both parties, and executed with proper notice. The Parties understand and agree that no failure or delay by either Party in exercising any right, power or privilege reserved hereunder shall operate as a waiver thereof, nor shall any single or partial exercise thereof preclude any other or further exercise thereof. I have read this document and understand it. I further understand that by signing this release, I voluntarily surrender certain legal rights.
